Terms of Service

Last updated: October 24, 2026

These Terms of Service ("Terms") are an agreement between you and White Whale Agency, LLC, a Delaware limited liability company ("White Whale", "we", "us"), which operates Vlibr. They govern your use of the Vlibr website, web app, shared video pages and embeds, and desktop app (the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use Vlibr on behalf of a company or other organization, you confirm that you have authority to accept these Terms for it, and "you" includes that organization.

1. Who can use Vlibr

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you may use it only with the permission of a parent or guardian, who agrees to these Terms on your behalf. In the European Economic Area and the UK, users under 16 need a parent's or guardian's permission. You may not use the Service if you are barred from doing so under applicable law.

2. Your account

You are responsible for your account and everything that happens under it. Give us accurate information, keep your sign-in method secure, and tell us promptly through our contact form if you suspect unauthorized access. We are not responsible for losses caused by someone else using your account without your permission.

3. Workspaces and teams

Content in Vlibr lives in workspaces. The owner of a workspace controls it: they manage its members, plan and billing, and can view, manage or delete the content in it. Workspace admins can help manage members. If you create content in a workspace owned by someone else, that content belongs to the workspace and may stay there if you leave or your access is removed.

Each paid workspace is billed per seat. If you invite members, you are responsible for making sure they follow these Terms.

4. Your content

You own the videos, recordings, comments and other material you create or upload ("Your Content"). We do not claim ownership of it.

To run the Service, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transcode, render, display and distribute Your Content, only as needed to operate, secure and improve the Service and to do what you ask — for example, playing a video for people you share it with. This license ends when Your Content is deleted from the Service, except for copies in backups that are overwritten in the normal course, and content others have already received.

When you share a link to a video, anyone with that link can watch it; when you embed a video, it can be watched wherever it is placed. You are responsible for who you share with.

You are responsible for Your Content. You confirm that you have all the rights needed to upload and share it, and that it does not violate these Terms or anyone's rights. Recording laws differ by country: if your recordings include other people — for example on a call or a camera — it is your responsibility to obtain any consent the law requires.

We do not use Your Content to train artificial intelligence models, and we do not sell it.

5. Acceptable use

You agree not to use the Service to:

  • break any law, or help anyone else do so;
  • upload or share content that is illegal, infringes someone's intellectual property or privacy, or is sexually exploitative of minors (which we report to the authorities);
  • harass, threaten, defame or discriminate against anyone, or promote violence or hatred;
  • record or share people without the consent required by law;
  • distribute malware, phishing, spam or deceptive content;
  • access other accounts or data without permission, or probe, scan or test the security of the Service;
  • interfere with or overload the Service, or get around its usage limits, paywalls or security features;
  • use the Service as general file hosting or a content-delivery network unrelated to video communication;
  • copy, resell, reverse engineer or build a competing product from the Service, except where the law allows it;
  • scrape or collect data from the Service by automated means without our written permission.

We may remove content or restrict accounts that we reasonably believe violate this section.

6. Plans, billing and cancellation

  • Free plan. The Free plan is free of charge and includes usage limits — such as the number of stored videos, recording length, downloads and monthly video bandwidth — described on our Pricing page. When a limit is reached, some features (for example, playback on share pages) may be paused until the next month or until you upgrade.
  • Pro plan. Pro is a paid subscription billed per seat, in advance, monthly or yearly. Prices and any usage limits for Pro (such as maximum recording length and fair use of bandwidth) are shown on our Pricing page and at checkout. Taxes may be added where required.
  • Automatic renewal. Subscriptions renew automatically at the end of each billing period, at the then-current price, until you cancel. By subscribing, you authorize us (through Stripe, our payment processor) to charge your payment method for each renewal and for seats you add.
  • Cancellation. You can cancel at any time from your billing settings. Cancellation stops the next renewal; your workspace keeps Pro until the end of the period you already paid for.
  • No refunds. Payments are non-refundable, including for partially used periods, unused seats, or if you cancel early, except where a refund is required by law.
  • Failed payments. If a renewal payment fails, we will notify you and retry for a limited period. If payment is still not made, the workspace's subscription ends: your content is kept, but the workspace is restricted until you renew.
  • Price changes. We may change our prices. We will give you reasonable advance notice, and a new price will apply from your next renewal; you can cancel before it takes effect.

7. The desktop app

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Vlibr desktop app to access the Service. The app may update itself automatically. It includes third-party open-source components, which are licensed under their own terms — see our Open-source licenses page; nothing in these Terms limits your rights under those licenses.

8. Our intellectual property and feedback

The Service — including its software, design, logos and the Vlibr name — belongs to White Whale and its licensors and is protected by law. These Terms do not give you any right to use our trademarks.

If you send us ideas, suggestions or feedback, we may use them freely and without any obligation to you.

10. Suspension and termination

You can stop using the Service and delete your account at any time from your account settings. Deleting your account permanently deletes the workspaces you own and their content.

We may suspend or terminate your access, or remove content, if you materially or repeatedly breach these Terms, if required by law, or to protect the Service, our users or others. Where reasonable, we will give you notice and a chance to fix the problem first. We may also discontinue the Service; if we do, we will give you reasonable notice so you can download your content.

Sections that by their nature should survive — including ownership, disclaimers, limitation of liability, indemnity and governing law — survive termination.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted, error-free or that content will never be lost — keep your own copies of anything important.

12. Limitation of liability

To the fullest extent permitted by law, White Whale and its members, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to the Service or these Terms, even if we were told such damages were possible.

Without limiting the above, and to the fullest extent permitted by law, we are not responsible for any loss, corruption or unavailability of Your Content or other data — whether caused by a technical failure, a security incident, an outage at one of our providers, or any other cause. You are responsible for keeping your own copies of anything that matters to you.

Our total liability for any claim arising out of or related to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) US $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under mandatory law.

13. Indemnity

You agree to defend and indemnify White Whale against any third-party claims, losses and costs (including reasonable legal fees) arising from Your Content or your breach of these Terms or the law.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you and we consent to their jurisdiction. Before filing a claim, please contact us through our contact form — most problems can be solved quickly that way. If you are a consumer living outside the United States, you may also have the right to bring a claim in your local courts under mandatory consumer law.

15. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you by email or in the Service at least 14 days before it takes effect, unless it is required sooner by law or for security. By continuing to use the Service after a change takes effect, you accept the updated Terms; if you do not agree, stop using the Service and cancel any subscription.

16. General

These Terms and our Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them in connection with a merger, acquisition or sale of assets. Neither party is responsible for delays caused by events beyond its reasonable control. If these Terms are translated, the English version governs.
